Reasons You Can Be Stopped: The standard for a
traffic stop is lower, and is known as reasonable
suspicion/reasonable cause. In order to make a lawful traffic
stop, an officer must be able to articulate why they suspect a
criminal act may have occurred (i.e. erratic driving, high
speed, matching vehicle or driver description to another
crime, or some other indication that a law is being violated).
In other words, an officer needs a reason to make a traffic
stop and cannot stop someone simply on a whim.
There are a number of steps law enforcement can take to
determine if a driver is intoxicated beyond the legal limit. Most
officers will look for general signs that alcohol or drug use has
occurred, including slurred speech, bloodshot eyes,
disheveled appearance, alcohol on the breath, an open
container of alcohol, drug paraphernalia, and loud behavior.
Usually officers will almost always require suspected drivers
to perform Standard Field Sobriety Tests, which challenge
the driver's mind-body coordination. After the driver has
performed those tests, law enforcement will typically test the
driver's breath to get a more accurate reading of the amount
of alcohol or drugs in the body. Because driving under the
influence increases the chances of causing a death, an
accident or injury, judges and prosecutors seek harsh
punishments for DUI offenders.
Individuals convicted of DUI face multiple legal penalties
including monetary fines, probation, jail, rehabilitation,
impoundment and/or conviscation of their vehicle, alcohol
counseling, community service, and/or an additional form of
financial responsibility called an SR-22. Also, you will have a
permanent criminal record for the rest of your life. A DUI
conviction often results in higher insurance premiums for
years to come. In some states, if you are not a U.S. citizen, a
DUI conviction can result in deportation.
With a criminal record, consequences can be far-reaching.
You may not be able to get the job you want. You won't
qualify for a commercial driver's license.
If this is your second offense or more, you could face
mandatory jail time. Even if this is your first offense, if you are
convicted of a DUI with 0.2% or higher, mandatory jail time
may be your fate, depending on the laws in your state.
In many states, your DUI convictions cannot be removed or
expunged from your record.
ZERO Tolerance & UDD - Underage Drunk
Driving
All states have zero tolerance laws that target drivers under
the legal drinking age. These laws penalize persons under 21
for operating a vehicle with any trace of alcohol in their
systems, with a BAC above 0.0% or with negligible BAC
levels such as 0.01% or 0.02%. You may be charged with
U.D.D. or Underage Drunk Driving.
Enhanced Penalty BAC Many states impose harsher
punishments or penalties on DUI offenders with particularly
high BAC at the time of the offense, typically .15% to 0.20%.
DUI offenders with a BAC at or above their state's Enhanced
Penalty Standards could face additional jail time, harsher
fines, and more severe driver's license sanctions.
Multiple Offenders Most states are imposing very harsh
punishments and/or penalties for multiple offenders.
