
The Texas penal code states that "A
person commits an offense if the person is intoxicated while operating a motor
vehicle in a public place." The term "intoxication" can mean one of two things.
The first is having impaired use of mental or physical faculties (because of
alcohol or any other substance--even prescribed medicine).
The second is having a BAC (Blood Alcohol Content) of 0.08 or more. Also,
according to Texas law, it is illegal for anyone under 21 to drive if there is
any detectable amount of alcohol in the blood (zero tolerance). Either offense
can result in a charge of DWI (Driving While Intoxicated), sometimes called DUI
for Driving while Under the Influence. .After a DWI/DUI charge, you will lose your right to drive unless you
