Suspensions & Revocations

With an Oklahoma DUI charge you are going to face two separate sets of penalties. One is Administrative, and the other is through the Oklahoma criminal courts system. The penalties seem similar, but they are different and may run concurrently. Once you have received an Oklahoma DUI, the state initiates two simultaneous, yet separate legal actions against you. The criminal action is in response to the ticket that was issued to you, while the administrative action is brought against your driver's license by the Oklahoma Department of Public Safety. Both actions can result in the suspension of your driving privileges, and it is important to understand that there may be additional penalties to consider and that each action must be handled on its own.

Implied Consent
When you received your driver's license, you accepted that the issuing state would have the right to require you to submit to chemical testing in the event you are suspected of drunk driving or driving under the influence of drugs. If at the time of your traffic stop, you either refuse to submit to such a test, or your test results exceed the limit set by your jurisdiction, your license will be administratively suspended.

Oklahoma or DUI (driving under the influence) Administrative Hearing

If you fail to request an Administrative Hearing within fifteen (15) days, your right to the hearing is lost, and your Oklahoma driver's license is automatically suspended for the specified term.
