Congress established the Superior Court of the District of Columbia as the trial court of general jurisdiction for the District of Columbia in 1970. The court consists of a chief judge and 61 associate judges. The court is assisted by the service of 24 magistrate judges as well as retired judges who have been recommended and approved as senior judges.

The Superior Court handles all local trial matters, including civil, criminal, family court, probate, tax, landlord-tenant, small claims, and traffic. DWI vs. DUI in District of Columbia

District of Columbia law makes a distinction between "driving while intoxicated" (DWI) and "driving under the influence" (DUI). An individual is convicted of DWI his or herblood alcohol content (BAC) is 0.08% or higher; while an individual is convicted of DUI with a BAC of 0.05% or higher. Though DUI in District of Columbia is a lesser offense, the penalties are severe and often result in similar consequences.


District of Columbia DWI/DUI arrests allow for two separate cases: a DWI/DUI criminal case, that is prosecuted in the District of Columbia criminal courts, and an administrative case, which can result in the suspension of driving privileges by the Washington DC Department of Motor Vehicles.

Administrative License Suspension/Revocation
The Administrative License Suspension/Revocation penalties applies minimum mandatory penalties imposed on drivers whose BAC is above the state limit for intoxication, or drivers who refuse to submit to BAC testing. First Offense 6 months; Second Offense 1 year; Third Offense 2 years.

District of Columbia law grants an individual 10 days to request a hearing from the Department Motor Vehicles. If you fail to request a hearing within 10 days, your right to the hearing is lost, and your license is automatically suspended for the applicable statutory time frame.
