Find an Alaska DUI Lawyer

If charged with DUI in Alaska, there are two charges - a civil charge and a criminal charge. The proceeding for the civil charge is called an administrative hearing and is held to determine whether or not your license suspenscion will be upheld or dismissed. Your first step is to hire a qualified Alaska DUI Lawyer who will file a request for an administrative hearing within 7 (seven) days of having received your ticket.

This is a very important aspect to your DUI charges and your case. This Administrative Hearing is separate from the proceeding for the criminal charge. You will not be sentenced to incarceration during this hearing. However, it is equally important because it concerns your driving privileges. Depending upon the outcome of this Administrative Hearing, you could have a suspended, revoked, restricted or otherwise inhibited license. It is important that you have your DUI defense attorney present. Your Alaska DUI attorney will champion your rights and make sure you receive the shortest license suspension possible at your Administrative Hearing. A lengthy license suspension could be detrimental to your job, family and other responsibilities.

YOU HAVE 7 (seven) DAYS IN WHICH TO REQUEST AN ADMINISTRATIVE HEARING

If you have been charged with an Alaska DUI it is important to realize that time is very critical. Alaska DMV Administrative Hearing: http://state.ak.us/dmv/akol/hearing.htm

When you are arrested for DUI in Alaska, the arresting officer will immediately suspend your driver's license and give you a "Notice and Order of Revocation," which serves as your temporary driver's license for seven days. You must request an administrative hearing in writing with the Alaska DMV within this seven-day window if you wish to prevent having your driver's license revoked for the full 90-day period.

When you make this request, the DMV will issue you another temporary license that is valid until the date of your hearing.
